Are Arrest Records Public Information in Passaic, New Jersey?

Arrest records are considered as public records in Passaic County, New Jersey. This implies that members of the public, who by the way, do not have to be residents of the county are allowed to request for it freely.

The New Jersey Public Records Act provides the necessary laws that govern access to public records in Passaic, and based on these laws most basic arrest and booking information can be accessed by the public, however, there are restrictions that limit access to full criminal histories and other sensitive information such as personal identifiers, juvenile arrests, victim or witness information, expunged data, and ongoing investigations.

There are quite a number of available options for conducting an arrest record search at state and federal levels in Passaic County, New Jersey. 

The first place to look without going through county channels is the New Jersey State Police, where online, mail, and in-person options are available to the public for records requests. People can either fill out the form for Open Records Requests Act (OPRA) requests to obtain general data on arrest, or carry out a criminal history check. However, criminal history checks are only available to record subjects, the government, or qualified business agencies seeking to carry out background checks on potential employees. These checks are mostly name-based or fingerprint based, and there are fees that would be requested based on the type of search. The New Jersey Judiciary also offers online access to court information, where one can view some arrest data. This search can be conducted using the downloadable records requests form or via the PROMIS/GAVEL public access portal for criminal case search. 

The Department of Corrections also provides inmate searches using the  “Offender Search” portal on its official website, where interested persons can view arrest data about incarcerated individuals. Searches here are free and can be conducted using an SBI number, Firstname, and Lastname.  

Federal arrest records can generally be accessed through the Public Access to Electronic Court Records (PACER) for the New Jersey District. 

Passaic County Inmate Locator

The official county inmate locator for Passaic County, New Jersey is hosted by the Sheriff’s Office on its official website. However, it is important to note that Passaic County does not operate its own jail facility, but all persons incarcerated in the county are either housed at Bergen County Jail or Hudson County Correctional Center. Therefore, to access inmate information, users are advised to contact either of these facilities.

Bergen County Jail provides an online inmate lookup tool available on its official website that allows users to search for inmates within the county, using their booking number, name(s), or date of birth. The Hudson Correctional Center on the other hand does not provide an online search tool for locating inmates, interested persons can contact them directly through their contact details on their official website. 

Active Warrant Search in Passaic County

In Passaic County, arrest warrants refer to an authorization issued by the court to law enforcement, instructing them to apprehend a person and bring them into custody. Warrants  are usually issued by the superior or municipal court judges when there is a probability that the named person has committed a crime. They mostly contain the suspect’s identity, charges, and judicial authorization.    

As much as the Passaic County Sheriff’s office is saddled with the responsibility of maintaining and executing arrest warrants, they are not published online, in keeping with the N.J.S.A. 47:1A-1.1 (OPRA exemptions), which categorizes them as criminal investigatory records. 

For persons interested in looking up active warrants, the Sheriff’s Office Warrant Division should be contacted on 973-389-5900. The New Jersey Courts Public portal also offers some active warrant information under criminal case data, and in-person visits at the issuing courthouse would also be a good option. Requesters should also note that the availability of these active warrants may vary based on the legal implications of disclosure.

How to Find Arrest Records for Free in Passaic County

As it has been mentioned earlier in some of the sections, there are a few free options for accessing arrest records in Passaic County, New Jersey. Most of these options are online and they come with zero charges, however, the information disclosed may be limited and basic. For a comprehensive record, one would be required to meet the legal requirement and also pay some fees to obtain it.

The most readily accessible option is the New Jersey Courts Public Case Search (PROMIS/Gavel) tool, which is hosted on the court’s official website. The Sheriff’s Office also provides an online inmate search option, however, because the county does not operate its own jail, it redirects the requester to the two options for arrest data inquiry, which include Hudson County Correctional Center and Bergen County Sheriff’s Office. 

Kindly note that these online searches generally require no form of ID. However, search criteria such as name, case number, DOB, or other booking details would be required, and for some in-person requests, you might need to show some ID.

A person may also visit the sheriff’s office or county court in person to inspect arrest records, under the Open Records Act (OPRA) of New Jersey. 

Passaic County Arrest Report

In Passaic County, an arrest report refers to a detailed document that contains the narration of an arrest, prepared by the arresting officer, after the arrest. It usually contains a description of the events that led to the arrest, the time, location, evidence, and probable cause for custody. Contrary to an arrest record, which is a summary entry in booking or court systems, the arrest report contains firsthand observations, witness statements, and other investigative details that provide an explanation for why and how the arrest occurred.  

Arrest reports form a fundamental part of a broad spectrum of police incident or investigative reports, which are maintained by local law enforcement or the Sheriff’s Office. The agency that handled the arrest may request for this document, however, access to it is often very limited or even redacted because they often qualify as part of criminal investigatory records under New Jersey law, especially in an ongoing case. 

How to Get an Arrest Record Expunged in Passaic County

In Passaic County, the state law makes provision for expungement not under some county system, and New Jersey permits actual expungement and not just sealing of records under N.J.S.A. 2C:52-1 et seq., this implies that the records would be removed from the public and treated as though the crime never occurred before. 

The process of filing for expungement in Passaic County, begins with contacting the Superior Court to file a petition, which can also be done online through the New Jersey Courts website.
